Senate passes key US surveillance program reauthorization after midnight deadline

The Senate narrowly avoided a lapse in a key U.S. surveillance law by voting early Saturday to reauthorize Section 702 of the Foreign Intelligence Surveillance Act. The legislation, approved 60-34 with bipartisan support, will extend the program for two years and now awaits President Joe Biden's signature. The program, which allows the government to collect communications of non-Americans outside the U.S. without a warrant, has been touted as crucial in disrupting terror attacks and foreign espionage. However, the reauthorization faced significant challenges as lawmakers debated the balance between national security and civil liberties.

The Biden administration had warned that allowing the program to lapse could have serious consequences, including the potential for missing key intelligence that could put troops in harm's way or lead to domestic threats. Attorney General Merrick Garland praised the reauthorization, emphasizing the importance of the tool to the Justice Department. Despite the urgency of the situation, a group of progressive and conservative lawmakers pushed for amendments to address civil liberty concerns, particularly regarding the FBI's access to Americans' communications through the program.

The debate over requiring a warrant for accessing American communications highlighted the tension between protecting privacy and responding to national security threats. While some lawmakers argued that obtaining a warrant was essential to safeguarding constitutional rights, others warned that such a requirement could hinder officials' ability to quickly respond to imminent threats. In the end, Majority Leader Chuck Schumer struck a deal to allow floor votes on amendments in exchange for expediting the passage process. However, the proposed amendments ultimately failed to garner enough support to be included in the final bill.

The reauthorization of Section 702 comes after reports of abuses and mistakes by FBI analysts in querying the intelligence repository for information about Americans, raising concerns about the potential for privacy violations. Despite these challenges, the Senate's approval of the legislation ensures that the surveillance program will continue to operate, providing intelligence crucial to national security efforts.
